This policy explains which law governs our dealings with the customer, and where a dispute arising out of them is heard.
Which law governs?
These Terms and Conditions, and any separate agreement under which we supply the customer with products or services, are construed under and governed by the laws of Malaysia; its conflict of law provisions are not applied. Accessing or using the website and its services amounts to agreement with what follows.
Which courts have jurisdiction?
Those of Malaysia, exclusively. Two points fix the reach of that:
Any dispute, controversy or claim that arises out of or relates to use of this website, to a transaction concluded on it, or to the breach, termination or invalidity of these Terms falls within the exclusive jurisdiction of the courts of Malaysia.
Objections to venue are waived: the customer surrenders any challenge to the place of legal proceedings, whether cast as an inconvenient forum or on any comparable footing.
What applies to access from outside Malaysia?
Suitability beyond this jurisdiction is not something we assert:
No representation is made that the materials, products or services offered here are appropriate for use, or obtainable, in other locations.
Compliance rests with the customer: anyone reaching this site from outside Malaysia answers for observing applicable local laws.
